Description of Services

AutoHive Direct services include:

Accepting and reviewing auto financing applications from consumers.
Matching applicants with lenders from our network of independent third-party lending institutions based on the applicant's credit profile, income, and financing needs.
Facilitating communication between applicants, lenders, and partner dealerships.
Providing informational tools including a payment calculator, educational content, and frequently asked questions.
Operating a referral program that rewards individuals who refer qualifying applicants.

Our services are offered through our website (www.autohivedirect.com), by telephone at (440) 547-5973, by email at info@autohivedirect.com, and through any other communication channels we make available.

AutoHive Direct Is not a Lender or Dealership

Critical Disclosure: AutoHive Direct is a financing intermediary. We are not a bank, credit union, lender, direct financing company, or automobile dealership. We do not make loans, extend credit, set interest rates, determine loan terms, or sell vehicles.

AutoHive Direct acts solely as an intermediary connecting consumers with independent third-party lenders and dealerships. You should understand the following:

All financing decisions — including approval, denial, interest rate, loan amount, term length, down payment requirements, and any other loan terms — are made exclusively by the third-party lender, not by AutoHive Direct.
All vehicles are sourced from and sold by independent partner dealerships, not by AutoHive Direct. We do not own, possess, inspect, certify, or warranty any vehicle.
AutoHive Direct does not guarantee that any lender will approve your application or that any specific terms will be offered.
Your contractual relationship for financing is between you and the lender. Your contractual relationship for the vehicle purchase is between you and the dealership. AutoHive Direct is not a party to either contract.

Eligibility

To use our services and submit a financing application, you must meet all of the following requirements:

You must be at least 18 years of age (or the age of majority in your state of residence, if older).
You must be a legal resident of the United States with a valid U.S. mailing address.
You must possess a valid U.S. driver's license or state-issued identification.
You must have a verifiable source of income sufficient to support the financing you are requesting.
You must have the legal capacity to enter into a binding contract.
All information you provide must be truthful, accurate, and complete.

By submitting an application, you represent and warrant that you meet all of the above eligibility requirements. Providing false, misleading, or incomplete information is a violation of these Terms and may constitute fraud under applicable federal and state law.

The Application Process

When you submit a financing application through AutoHive Direct, the following occurs:

(a) Application Submission

You provide personal, financial, and employment information through our online application form, by phone, or through other communication channels. By submitting your application, you authorize AutoHive Direct to use this information for the purpose of matching you with lenders and facilitating your financing request.

(b) Application Review and Lender Matching

AutoHive Direct reviews your application and matches you with one or more lenders from our network whose lending criteria align with your credit profile and financing needs. Your application information will be shared with these lenders for evaluation.

(c) Lender Decision

Each lender independently evaluates your application and makes its own credit decision. AutoHive Direct has no authority over and assumes no responsibility for any lender's approval or denial decision, the terms offered, or the speed of the decision process.

(d) Vehicle Selection

If financing is approved, you will work with a partner dealership to select a vehicle that falls within the parameters of your approved financing. AutoHive Direct may facilitate this introduction but is not a party to the vehicle sale.

(e) Transaction Completion

All loan agreements are executed directly between you and the lender. All vehicle purchase agreements are executed directly between you and the dealership. AutoHive Direct is not a signatory to, guarantor of, or party to any financing or purchase contract.

Credit Inquiries and Consumer Reports

By submitting a financing application, you provide your written authorization and consent for AutoHive Direct and/or our partner lenders to:

Obtain one or more consumer reports (credit reports) from national consumer reporting agencies, including but not limited to Equifax, Experian, and TransUnion.
Verify the information you have provided, including employment, income, identity, and residence.
Use the information obtained from consumer reports to evaluate your financing application and match you with appropriate lenders.

You understand that:

An initial inquiry by AutoHive Direct may be a soft pull (which does not affect your credit score) or a hard pull depending on the stage of the application process.
Once your application is submitted to partner lenders, those lenders may conduct their own hard credit inquiries, which may appear on your credit report and may temporarily affect your credit score.
Multiple inquiries from auto lenders within a 14-day window are typically treated as a single inquiry by credit scoring models (FICO, VantageScore), consistent with rate-shopping provisions.

This authorization remains valid for 90 days from the date of your application or until you withdraw your application in writing, whichever occurs first.

No Guarantee of Approval or Terms

AutoHive Direct makes no representation, warranty, promise, or guarantee that:

Any applicant will be approved for financing.
Any specific interest rate, loan amount, term length, monthly payment, or down payment amount will be offered.
Financing terms discussed during the application process will be the final terms offered by a lender.
Any specific vehicle will be available, or that vehicle pricing will remain as quoted.
The application process will be completed within any specific timeframe.

Statements on our website regarding "same-day approvals," minimum down payment amounts, or acceptance of all credit situations describe the general capabilities of lenders in our network and do not constitute a guarantee that any individual applicant will receive such terms. Actual results depend on your individual credit profile, income, employment, the specific lender, and other factors outside of AutoHive Direct's control.

Partner Lenders and Dealerships

AutoHive Direct maintains relationships with a network of independent third-party lenders and automobile dealerships. You acknowledge and agree that:

Partner lenders and dealerships are independent businesses and are not owned, operated, controlled, or employed by AutoHive Direct.
AutoHive Direct is not responsible for the actions, omissions, practices, policies, or representations of any partner lender or dealership.
Any disputes regarding your loan terms, interest rate, payment schedule, or other financing matters are between you and the lender.
Any disputes regarding vehicle condition, pricing, title, registration, warranties, or the sale transaction are between you and the dealership.
AutoHive Direct does not endorse, guarantee, or assume liability for any specific lender or dealership in our network.

Vehicle Condition and Warranties

AutoHive Direct does not sell, inspect, certify, appraise, or warranty any vehicle. All vehicles are sold by independent partner dealerships. You are strongly encouraged to:

Conduct a thorough personal inspection of any vehicle before completing a purchase.
Obtain an independent pre-purchase inspection from a qualified mechanic.
Review the vehicle history report (e.g., Carfax, AutoCheck) before purchasing.
Carefully read and understand all documents provided by the dealership, including any "As-Is" disclosures, buyer's guides, warranty information, and the purchase agreement.

AutoHive Direct makes no representations or warranties, express or implied, regarding the condition, safety, reliability, mileage accuracy, title status, or fitness for any particular purpose of any vehicle sold by a partner dealership. Any warranty coverage is between you and the dealership and/or a third-party warranty provider.

Fees and Costs

(a) AutoHive Direct Services

There is no fee charged to consumers for submitting an application through AutoHive Direct. Our application process is free.

(b) Lender and Dealership Fees

Partner lenders and dealerships may charge their own fees in connection with your financing and vehicle purchase, including but not limited to origination fees, documentation fees, title and registration fees, dealer preparation fees, GAP insurance, extended warranties, and other products or services. These fees are determined and collected by the lender or dealership, not by AutoHive Direct. You should carefully review all fee disclosures provided by the lender and dealership before signing any agreement.

(c) Broker Compensation

AutoHive Direct may receive compensation from partner lenders and/or dealerships for successfully connecting applicants with financing. This compensation does not increase the cost of your loan and is paid by the lender or dealership, not by you.

Referral Program

AutoHive Direct operates a referral program as described on our website at www.autohivedirect.com/referral-program. By participating in the referral program, you agree to the following terms:

Referral rewards are paid only when the referred individual submits a complete financing application and completes a qualifying transaction (financing approval and vehicle delivery) through AutoHive Direct's network.
The referring party must be identified at the time the referred individual submits their application. Retroactive referral claims will not be honored.
Referral reward amounts, eligibility criteria, and payment timelines are determined by AutoHive Direct at its sole discretion and may be modified or discontinued at any time without prior notice.
You may not refer yourself. Employees of AutoHive Direct, partner lenders, and partner dealerships may be ineligible for referral rewards.
Referral rewards may be subject to applicable tax reporting requirements. You are responsible for reporting any referral income on your tax returns.
AutoHive Direct reserves the right to withhold or revoke referral rewards in cases of fraud, misrepresentation, or abuse of the program.

By referring an individual to AutoHive Direct, you represent that you have that individual's consent to provide their contact information to us.

Communication Consent

By providing your contact information to AutoHive Direct — whether through a financing application, appointment request, contact form, referral form, or any other method — you expressly consent to the following:

(a) Transactional Communications

You consent to receive communications from AutoHive Direct related to your application, appointment, or inquiry via telephone (including calls to mobile phones), email, and text message (SMS/MMS). These include application status updates, appointment confirmations and reminders, document requests, and follow-up communications necessary to process your request.

(b) Marketing Communications

If you separately opt in to marketing communications, you may receive promotional messages about our services, special offers, or educational content. You may opt out of marketing communications at any time by: (a) clicking "unsubscribe" in any marketing email; (b) replying STOP to any marketing text message; or (c) contacting us at info@autohivedirect.com or (440) 547-5973.

(c) Text Message Terms

Standard message and data rates may apply to text messages. Message frequency varies based on your application status and communication preferences. Text HELP for assistance or STOP to cancel. Consent to receive text messages is not a condition of receiving financing through AutoHive Direct.

(d) Call Recording

Telephone calls with AutoHive Direct may be recorded or monitored for quality assurance, training, compliance, and record-keeping purposes. By calling us or accepting our calls, you consent to such recording.

User Conduct and Prohibited Uses

You agree that you will not use the AutoHive Direct website or services to:

Submit false, misleading, fraudulent, or incomplete information in a financing application or any other form.
Impersonate another person or submit an application on behalf of another individual without their express written consent.
Use the website or services for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation.
Attempt to gain unauthorized access to our website, servers, databases, or any connected systems or networks.
Transmit any viruses, malware, or other harmful computer code.
Scrape, crawl, or use automated tools to extract data from our website without our written permission.
Interfere with or disrupt the functionality or security of our website or services.
Use our website or services to collect personal information about other users.
Abuse, harass, or threaten AutoHive Direct employees, agents, lenders, or dealership personnel.

AutoHive Direct reserves the right to refuse service, reject applications, and terminate access to our website for any user who violates these Terms or engages in conduct that we determine, in our sole discretion, to be harmful, fraudulent, or abusive.

Intellectual Property

All content on the AutoHive Direct website — including but not limited to text, graphics, logos, images, icons, photographs, audio and video content, software, code, page layout, and the compilation and arrangement thereof — is the property of AutoHive Direct or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.

The AutoHive Direct name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AutoHive Direct. You may not use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the website for personal, non-commercial purposes in connection with seeking auto financing services. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website without our express written consent.

To the fullest extent permitted by applicable law, AutoHive Direct disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:

Any defects in the website will be corrected.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUTOHIVE DIRECT, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

Your use of or inability to use the website or services.
Any decision made by a lender to approve, deny, or modify your financing application.
The terms, conditions, interest rate, or other aspects of any financing offered by a third-party lender.
The condition, quality, safety, or fitness of any vehicle purchased from a partner dealership.
Any action or omission of any partner lender, dealership, or other third party.
Unauthorized access to or alteration of your personal information.
Any errors, inaccuracies, or omissions in website content, tools, or calculators.

In no event shall AutoHive Direct's total aggregate liability to you for all claims arising out of or related to these Terms or your use of our services exceed one hundred dollars ($100.00). This limitation applies regardless of the legal theory upon which your claim is based, including contract, tort, negligence, strict liability, or any other basis.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless AutoHive Direct, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your breach of these Terms.
Your use of our website or services.
Any false, inaccurate, or misleading information you provide.
Your violation of any applicable law or regulation.
Your violation of any third party's rights, including privacy or intellectual property rights.
Any dispute between you and a partner lender or dealership.

Dispute Resolution and Arbitration

(a) Informal Resolution

Before filing any formal dispute, you agree to first contact AutoHive Direct at info@autohivedirect.com to attempt to resolve the dispute informally. We will make a good faith effort to resolve any complaint or dispute within 30 days of receipt.

(b) Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, the website, or the services — including the determination of the scope or applicability of this agreement to arbitrate — shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator in Cuyahoga County, Ohio, or at another mutually agreed location. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

(c) Class Action Waiver

YOU AND AUTOHIVE DIRECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

(d) Exceptions

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits. Nothing in this section prevents you from filing a complaint with any federal or state regulatory agency, including the Federal Trade Commission, the Consumer Financial Protection Bureau (CFPB), or the Ohio Attorney General.

(e) Opt-Out

You may opt out of this arbitration provision by sending written notice to info@autohivedirect.com within 30 days of first accepting these Terms. Your notice must include your full name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved under the Governing Law provision in Section 19.

Governing Law

These Terms and any dispute arising out of or related to them or the services shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. To the extent that any dispute is not subject to arbitration under Section 18, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Cuyahoga County, Ohio.

Termination and Suspension

AutoHive Direct reserves the right to terminate or suspend your access to our website and services at any time, with or without cause and with or without notice, including but not limited to situations where we believe you have violated these Terms, engaged in fraudulent activity, or provided false information.

You may discontinue your use of our services at any time. If you have a pending application and wish to withdraw it, contact us at info@autohivedirect.com or (440) 547-5973. Please note that withdrawal of an application does not retroactively reverse any credit inquiries that have already been conducted. Sections 2, 5, 6, 7, 8, 13, 15, 16, 17, 18, 19, and 22 of these Terms shall survive any termination.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

Entire Agreement and Waiver

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoHive Direct with respect to your use of our website and services. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and AutoHive Direct regarding the subject matter herein.

The failure of AutoHive Direct to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision shall be effective only if made in writing and signed by an authorized representative of AutoHive Direct.

Modifications to These Terms

AutoHive Direct reserves the right to modify, amend, or update these Terms at any time at our sole discretion. Material changes will be posted on this page with an updated "Last Updated" date. We may also notify you of significant changes by email or by displaying a notice on our website.
